英国疫情和后疫情时期租金纠纷政策解读

租客:

  • ­由于英国疫情,我的收入减少,不能继续按合同承担全部租金
  • ­­由于英国疫情,我被公司裁员了,不能继续按合同履约

房东:

  • ­我的房客已经拖欠一个月房租了,因为covid-19,不够钱缴纳房租
  • ­房客要求我减免租金,因为疫情刚开始时公司裁员,租客工作没了
  • ­我的租金减少不能cover我的银行贷款了

针对疫情期间租赁会产生的问题,英国政府出台相关政策,其中3月28日住房事务部、社区和地方政府(Ministryof Housing, Communities& Local Government)针对租赁房租发表了指导文件。原始文件请看链接如下:

针对租客和房东同时关心的疫情期间地房租问题,Citian研读政策文件后总结以下几点,对房东租客可能存在的租金纠纷都有指导意义:

1. 总的来说,房租是要交滴,毕竟租房合同的签订是具有法律效力的。小编相信,政府不会制定一项法律条例来反对另外一项法律条例,那不是自相矛盾,自己给自己找麻烦吗?所以,租房合同的法律效力,包括房租以及合同其他所有条例,房东和房客都应该继续遵守和执行。这也是对法律的尊重。

只是缴纳的形式,可以是双方友好协商之后,制定一个双方都同意且可执行的计划,这个可以是推迟一些时日交纳房租,毕竟大部分房东也有房贷需要缴纳,银行针对房贷的抗疫政策也只是推迟三个月收取,并不是完全免除;

也可以有毫无房贷压力的房东太太慷慨的说,房租免了,水电自付!体谅无论是留学生的无奈留下,还是被裁员或者被furlough的压力,这都有可能,前提是 沟通! 沟通! 沟

关于具体条例,可以参考如下:

1.1作为房客,我应该在疫情爆发期间停止支付租金吗?

• Tenants should continue to pay rentand abide by all other terms of their tenancy agreement to the best of their ability.The government has a strong package of financial support available to tenants,and where they can pay the rent as normal, they should do. Tenants who are unableto do so should speak to their landlord atthe earliest opportunity.

•租户应尽最大努力继续支付租金并遵守所达成协议的所有其他租赁条款。政府具有帮助租户正常支付其应该支付租金的一系列强大财务支持计划。依然有困难的租户应尽可能早的联系房东进行沟通。

• In many if not most cases, theCOVID-19 outbreak will not affect tenants’ ability to pay rent. If your ability to pay will beaffected, it’s important to have an early conversation with your landlord. Rentlevels agreed in your tenancy agreement remain legally due and you shoulddiscuss with your landlord if you are in difficulty.

•在大多数情况下(即使不是大多数情况),COVID-19爆发也不应该影响租户支付租金。如果您的付款能力会受到影响,请务必提早与房东交谈。租赁协议中约定的所缴纳租金的额度具有法律效力,如果您确实有困难,应尽早的和您的房东商量沟通。

2. 实在是没办法按时缴纳房租,肿么办?回到小编之前重复的,也是指导条例反复提到的:沟通!

持续沟通!

无论是发邮件,打电话,还是imessage,都请尽早的和联络房东或者中介,诚恳全面的去沟通,提前告知有可能会发生的情况,这样在提前预知的情况下,双发都好做及时的调整和预备;如果没有及时沟通,也不要拖欠房租,毕竟不要让自己在理亏的情况下去沟通,以及避免不必要的利息罚款;

如果房东实在是担心现任房客没有能力支付接下来的房租,同时又焦虑自己在三个月之后也没有能力一次性偿还银行三个月的贷款,第一不要着急,此种情况下,非要给与现任房客搬离通知,也必须是提前三个月的正式通知;第二也不要着急,当地政府有提供专家建议和资金支持。(下面有具体条例可供参考)

毕竟这次疫情的恐怖应该是绝大多数人人生第一次遇见,很多不知所措不可控制的情况下,选择多沟通,多商量,双方多理解,多包涵,多体谅的情况下,跟随政府颁布的指导方针,没有什么是不能好好解决的。

指导条例就如此说(小编也确实觉得很啰嗦,但还是有必要再说一遍):

•租户应继续支付租金并遵守租房合约中所达成的所有其他租赁条款。无法这样做的房客应该尽早与房东交谈。

• As part of our national effort to respond to the COVID-19 outbreak, it’s important that landlords offer support andunderstanding to tenants who may start to see their income fluctuate.

•作为我们国家应对COVID-19疫情的工作的一部分,重要的是房东提供支持和理解租客可能面对的收入波动。

• An early conversation between landlord and tenant can help both parties to agree a plan if tenants are struggling to pay their rent.

如果房客正面临为支付房租的困难,房东与房客之间的早期对话可以帮助双方协商。

This can include reaching a temporary agreement not to seek possession action for a period of time and instead accept a lower level of rent, or agree a plan to pay off arrears at a later date.

Where a landlord does choose to servenotice seeking possession for rent arrears or has done so already, the notice period and any further action will be affected by legislation lengthening the notice period (see Section 1.3) and/or the suspension of possession claims (seeSection 2).

• If a landlord and tenant agree a plan to pay off arrears at a later date, it is important they both stick to this plan, and that tenants talk to their landlord immediately if they are unable to do so.

• Local authorities can provide support for tenants to stay in their homes. If you are experiencing financial hardship,you may be able to access new funding; we have already made £500m available to fund households experiencing financial hardship and are determined to take action to support people in need.

•地方政府可以为租户提供支持。如果您(租客)遇到财务困难,您也许能够获资金支持;我们(政府)有已经提供了5亿英镑用于资助经历财务困难的家庭并将采取行动支持有需要的人。

最后总结,房租肯定是要交纳的,但是通过协商,房东房客互相理解和帮助的前提下,房租的问题总归能安好解决
